CONTRACT AWARD NOTIFICATION

According to the California Code of Regulations, Title 8, Chapter 2, Part 1, Section 230, Notification of Contract Award Information:

"Contractors shall provide contract award information to the apprenticeship committee or each applicable apprenticeable craft or trade in the area of the site of the public works project that has approved the contractor to train apprentices. Contractors who are not already approved to train by an apprenticeship program sponsor shall provide contract award information to all of the applicable apprenticeship committees whose geographic area of operation includes the area of the public works project. This contract award information shall be in writing and may be a DAS Form 140, Public Works Contract Award Information. The information shall be provided to the applicable apprenticeship committee within ten (10) days of the date of the execution of the prime contract or subcontract, but in no event later than the first day in which the contractor has workers employed upon the public work. Failure to provide contract award information, which is known by the awarded contractor, shall be deemed to be a continuing violation for the duration of the contract, ending when a Notice of Completion is filed by the awarding body, for the purpose of determining the accrual of penalties under Labor Code Section 1777.7. The DAS Form 140 or written notice shall include the following information, but shall not require information not enumerated in Section 230:

(1) the contractor's name, address, telephone number and state license number;
(2) full name and address of the public work awarding body;
(3) the exact location of the public work site;
(4) date of the contract award;
(5) expected start date of the work;
(6) estimated journeyman hours;
(7) number of apprentices to be employed;
(8) approximate dates apprentices will be employed"

JOURNEYMAN TO APPRENTICE RATIO

According to California Labor Code, Section 1777.5 (g):

"The ratio of work performed by apprentices to journeymen employed in a particular craft or trade on the public work may be no higher than the ratio stipulated in the apprenticeship standards under which the apprenticeship program operates where the contractor agrees to be bound by those standards, but, except as otherwise provided in this section, in no case shall the ratio be less than one hour of apprentice work for every five hours of journeyman work."

JOURNEYMAN TRAINING CONTRIBUTIONS

California Labor Code, Section 1777.5, requires that contractors performing Public Work must contribute to the either California Apprenticeship Council (CAC), or an approved apprenticeship program that can supply apprentices to the site of the Public Work project, the amount established in the applicable Prevailing Wage determination for all journeyman electrician hours worked on the contract. WECA qualifies as an approved apprenticeship program for all journeymen working throughout the State of California.

Any and all journeyman training contributions required by California Labor Code Section 1777.5 shall be paid by WECA Member Contractors to WECA ATC. If a member contractor belongs to another organization that offers a state-approved apprentice program for the electrical industry, the journeyman training contributions that, according to law, must be paid on Public Works jobs may be split between the programs in accordance to the ratio of apprentices' hours used from each program on a monthly basis.  

For example: if a contractor uses WECA apprentices, whose hours total 600 on a job for a month, and also uses apprentices from another program whose hours total 400 for the same month, at the minimum, WECA will be paid 60% of the monthly journeyman training fees.  Failure to comply with this policy may result in disciplinary action including but not limited to:  (1) losing “approved-to-train” status, (2) having all apprentices pulled, and (3) cancellation of membership. Information on Public Work wages can be found in the On-The-Job Conduct and Requirements section of this Handbook; applicable journeyman training contribution rates can be found on this Web site, or a member may call the WECA Customer Consultant at (877) 444-9322.

Member contractors shall utilize WECA's Journeyman Monthly Hours Worksheet to report their Public Work journeyman hours to WECA. This form must be received by WECA by the 15th of the month following the month in which the journeyman worked. A copy of the Worksheet can be found in the Forms section of this Handbook.

Contractors do not have to pay journeyman training contributions for journeymen employed on either State Private Work or Federal Davis-Bacon projects.
